Tribunal Procedure Committee opens consultation on new Martyn’s Law tribunal rules
Published on 29 June 2026, the consultation seeks views on amendments that would allow the First-tier Tribunal to effectively manage and determine applications made under section 11. These applications will enable “interested persons” to ask the Tribunal to rule on key questions about how Martyn’s Law applies to specific premises or events — including whether they fall within scope, whether enhanced duties apply, who holds responsibility, and whether a duty to cooperate arises.
The TPC is inviting feedback on:
- Whether changes to the existing Rules are necessary to accommodate section 11 applications.
- The specific amendments proposed to support clear presentation, case management, and decision‑making.
- Any additional rule changes that may be required as organisations begin preparing for Martyn’s Law implementation.
Two documents accompany the consultation:
- A consultation paper outlining the proposed amendments.
- A questionnaire for respondents wishing to provide structured feedback.
The consultation is open until 11:59pm on 27 July 2026.
This forms part of the wider programme of regulatory preparation for Martyn’s Law, which will introduce new duties for publicly accessible premises and events to strengthen terrorism preparedness and protection.
