Northern Ireland updates tobacco retailer rules ahead of new tobacco and vaping restrictions
New regulations have been made in Northern Ireland to update the rules governing tobacco retailers ahead of the introduction of wider restrictions on tobacco, vaping and nicotine products.
The Tobacco Retailer (Miscellaneous Amendments) Regulations (Northern Ireland) 2026 make a number of technical and administrative amendments to existing legislation governing the tobacco retailer register and enforcement arrangements. The changes are intended to ensure that the existing retailer registration and enforcement framework is aligned with the Tobacco and Vapes Act 2026, which significantly expands the range of products subject to regulation.
Among the amendments are changes to the information required for registration on the tobacco retailer register, together with updates to the contact details associated with the register. The framework is being expanded to cover retailers of vaping and other nicotine products alongside traditional tobacco retailers.
The regulations also amend the prescribed wording for restricted premises notices. The wording has been updated to reflect the broader range of regulated products, including tobacco products, herbal smoking products, vaping products, nicotine products and cigarette papers.
Changes have also been made to fixed penalty notices, including the removal of obsolete statutory references and the addition of electronic and online payment methods. The Department of Health has characterised the amendments as technical and consequential changes rather than the introduction of new policy.
The regulations form part of a wider programme of reforms under the Tobacco and Vapes Act 2026. In Northern Ireland, restrictions relating to the sale of vaping and nicotine products to under-18s, proxy purchasing, vending machines and the free distribution of relevant products are due to come into force on 29 October 2026.
The new tobacco age-of-sale provisions will follow on 1 January 2027, prohibiting the sale of tobacco products to people born on or after 1 January 2009. The expanded retailer registration requirements are expected to become enforceable from 1 March 2027, when fixed penalty notices can be issued for relevant registration offences.
The Department of Health has been working with councils and enforcement bodies to prepare for the changes, including through a joint implementation group involving local councils, the Department and the Public Health Agency.
