Government clarifies plans for new council powers over high street businesses

The Government has provided further details of how it intends to give local authorities greater powers to influence the mix of businesses operating on high streets, confirming that the changes will be delivered through a combination of new licensing measures, Gambling Impact Assessments (GIAs), and strengthened closure powers. 

The clarification came in response to a written parliamentary question from Sir James Cleverly, who asked what legal mechanism would be used to give councils new powers to restrict certain types of shops and which businesses would be affected.

Responding on behalf of the Government, Nesil Caliskan said the Government is taking action to give local authorities and communities “more powers to control the make up of their high street”. 

A key element of the proposals is the introduction of Gambling Impact Assessments (GIAs). Once brought into force, GIAs will provide licensing authorities with an additional evidence-based tool when considering applications for new gambling premises licences. The assessments are intended to help councils manage the number and concentration of new gambling premises where local circumstances justify doing so, complementing the existing gambling licensing framework under the Gambling Act 2005.

The Government also highlighted concerns over the growing number of vape shops on high streets. It confirmed that the Tobacco and Vapes Act provides powers to establish a new licensing scheme for the retail sale of tobacco, vaping and nicotine products. A consultation on introducing the retail licensing scheme is planned for 2027. 

In addition, the Government said it intends to strengthen enforcement powers against businesses involved in illegal activity. Subject to consultation, secondary legislation will be used to double the maximum duration of closure orders available to the police and local authorities, providing a longer period during which premises associated with criminal activity can be closed.
