{"id":9074,"date":"2024-05-16T00:00:00","date_gmt":"2024-05-16T00:00:00","guid":{"rendered":"https:\/\/instituteoflicensing.org\/news_archive\/2024\/05\/16\/consultation-consumption-of-alcohol-in-licensed-pavement-areas-off-sales\/"},"modified":"2024-05-16T00:00:00","modified_gmt":"2024-05-16T00:00:00","slug":"consultation-consumption-of-alcohol-in-licensed-pavement-areas-off-sales","status":"publish","type":"post","link":"https:\/\/instituteoflicensing.org\/news_archive\/consultation-consumption-of-alcohol-in-licensed-pavement-areas-off-sales\/","title":{"rendered":"Consultation: Consumption of alcohol in licensed pavement areas \/ off-sales"},"content":{"rendered":"<h2 class=\"gem-c-heading gem-c-heading--font-size-27 gem-c-heading--mobile-top-margin\"><a href=\"https:\/\/www.gov.uk\/government\/consultations\/alcohol-in-licensed-pavement-areas\">Consultation<\/a> <strong>description<\/strong><\/h2>\n<div class=\"gem-c-govspeak govuk-govspeak \" data-module=\"govspeak\" data-govspeak-module-started=\"true\">\n<div class=\"govspeak\">\n<p>Businesses such as pubs and restaurants are licensed to sell alcohol for customers to drink on the premises (\u2018on-sales\u2019).<\/p>\n<p>During the COVID-19 pandemic, the government passed regulations allowing them to sell alcohol for takeaway, delivery and to drink in licensed pavement areas (\u2018off-sales\u2019), without changing their licence.<\/p>\n<p>The regulations expire on 31 March 2025. This consultation sets out permanent options for alcohol licensing after this date. <strong>The consultation will run for 8 weeks ending on 11th July 2024.<\/strong><\/p>\n<h3 id=\"the-proposals-\">The proposals  <\/h3>\n<ul>\n<li>Option 1 \u2013 Make permanent the temporary regulatory easements for off-sales under the Business and Planning Act 2020, whereby any on-sales alcohol premise licence automatically covers off-sales as well.<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\">or<\/p>\n<ul>\n<li>Option 2 \u2013 Amend the Licensing Act to extend the definition of on-sales so that it includes consumption in a licenced pavement area.<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\">or<\/p>\n<ul>\n<li>Option 3 \u2013 Amend the Licensing Act to permit on-sales only premises licence holders the right to make off-sales to any area for which there is a pavement licence.<\/li>\n<\/ul>\n<p><strong>IoL Response<\/strong><\/p>\n<p><span>The IoL will be responding to this consultation. IoL members are invited to email their views to info@instituteoflicensing.org All views submitted will be taken into account when reviewing the IoL response.
