New guidance documents for preventing illegal working in licensed premises Published Date: 07/04/2022

Two new guidance documents for preventing illegal working in licensed premises have recently been published which may be of interest to Licensing Authorities:

  • Guidance for Immigration Enforcement staff on Partnership Working has been updated regarding the use of the s.179 of the Licensing Act 2003 power (as amended by the IA 2016) on operational visits and joint working with other licensing authorities. This is available on gov.uk.
  • New guidance for Home Office staff on preventing illegal working in licensed premises and the Home Office role as a responsible authority has also been published on gov.uk. The guidance includes the operational processes we follow when we receive licence applications. There is also section on the assessment of the entitlement to work for Licensing Authorities (page 16) and a list of acceptable documents (Annex E).
